Thank you for visiting Onewash online. This website is owned and operated by Onewash Pty Ltd (ACN 644 413 696). By accessing and/or using this website and membership services, you agree to these Terms and Conditions, which include our Privacy Policy (Terms). Please review our Privacy Policy and these Terms carefully and immediately cease using our website or terminate your membership if you do not agree to these Terms.

In these Terms, 'us', 'we' and 'our' means Onewash Pty Ltd (ACN 644 413 696).

  1. Guest and Membership Use

    You can use Onewash online as a guest without registering, or you can create a membership profile to access certain member features and fast future checkout. When you register and activate your account, you will provide us with personal information such as your name and email address, telephone number, and billing address. Please ensure that this information is accurate and current. We will handle all personal information we collect in accordance with our Privacy Policy.

    Each time you use Onewash online as a guest, or you create an account, you warrant to us that you:

    •                are at least 18 years of age;

    •                have the legal right and ability to enter into a legally binding agreement with us;

    •                have only used a payment card that is in your own name; and

    •                agree to use the website and our services in accordance with these Terms.

    •                Please contact us if you need to close your membership or need help.

  2. Making payments

    Onewash cares about your payment security and never collects or stores your payment details.  Your payment details are captured through a Square API, which processes your payment, and if you become a member, stores your payment details so you don’t have to enter them again next time. Square AU Pty Ltd ACN 167 106 176 is a licenced regulated payment provider that is PCI Compliant.   3. Protecting your account

    You can login to your membership using your email address and password. You are responsible for keeping your password secure and for all use and activity carried out under your username. To the extent permitted by law, we are not responsible for any loss, misuse or unauthorised access to your account.  You must contact us immediately if you think your account has been compromised and we will use reasonable efforts to stop further use. We will need you to quote your one-time pin (which we will send you) to provide help.

  4. Collection Notice

    We collect personal information about you in order to provide you with the ability to create a membership, process a payment, use Onewash store services, help you with problems, improve our services to you and for purposes otherwise set out in our Privacy Policy.

    We disclose that information to the Onewash location you use, and may disclose that information to third parties that help us deliver our services (including information technology suppliers, communication suppliers and our business partners) or as required by law. If you do not provide this information, we may not be able to provide all of our services and products to you. We may also disclose your personal information to recipients that are located outside of Australia, including to cloud service providers and credit card processors located in the United States of America.

    Our Privacy Policy explains: (i) how we store and use, and how you may access and correct your personal information; (ii) how you can lodge a complaint regarding the handling of your personal information; and (iii) how we will handle any complaint.     By providing your personal information to us, you consent to the collection, use, storage and disclosure of that information as described in the Privacy Policy and these Terms.

  5. Accuracy, completeness and timeliness of information

    The information on our website is not comprehensive and is intended to provide a summary of the subject matter covered. While we use all reasonable attempts to ensure the accuracy and completeness of the information on our website, to the extent permitted by law, including the Australian Consumer Law, we make no warranty regarding the information on this website.     For certain campaigns, promotions or contests, additional terms and conditions may apply. If you want to participate in such a campaign, promotion or contest, you need to agree to the relevant terms and conditions applicable to that campaign, promotion or contest. In case of any inconsistency between such terms and conditions and these Terms, those terms and conditions will prevail.

  7. Purchases

    The products and services we provide are available for purchase through our website. Although these items are available on our website, the fulfillment of these products and services are provided by our third-party providers eg a carwash location. It is the responsibility of these providers to ensure the services that you have purchased are provided to you as detailed by the website.

    Our website makes available to you four (4) payment tiers that a carwash location has decided to offer to access their products and services. By selecting one of these options, you are confirming your intention to purchase the selected product. At any point during the purchase, you have the ability to go back and review your selected option.  

    Pricing of the products and services provided on our website are set by our third-party providers in accordance with their own pricing policy. These prices are not subject to our decision and any complaints regarding pricing should be raised with the provider directly. These prices may fluctuate or change at the discretion of these third parties.

    All payments that are taken on our website are accepted and processed through a third-party payment processor. We ensure that all necessary security precautions and requirements are used to protect any credit card information provided in the use of our website. How this information is stored and secured is set out in our Privacy Policy.

    Once the payment for your order has been accepted, the purchase is completed and the product and/or service will be made available to you. Any cancellation, returns or exchanges must be made with the third-party provider that is or will be providing the product or service to you. For any reason, if the product or service fails to be provided to you as described on our website, we will make best efforts to provide you with the service or refund you the purchase amount.

    IN AUSTRALIA, OUR GOODS AND SERVICES COME WITH GUARANTEES THAT CANNOT BE EXCLUDED UNDER THE AUSTRALIAN CONSUMER LAW. ANY AND ALL OTHER WARRANTIES OR CONDITIONS WHICH ARE NOT GUARANTEED BY THE AUSTRALIAN CONSUMER LAW OR THE COMPETITION AND CONSUMER REGULATION 2010 ARE EXPRESSLY EXCLUDED WHERE PERMITTED, INCLUDING LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES CAUSED BY BREACH OF ANY EXPRESS OR IMPLIED WARRANTY OR CONDITION
